2.2 What We Are (and Aren't)
We Are:
- A curated online music studio connecting students with qualified, vetted music teachers
- A provider of comprehensive music education services with quality oversight
- Committed to maintaining high teaching standards and student safety
We Are NOT:
- A marketplace where anyone can sign up to teach (we carefully screen all teachers)
- A guarantor of specific learning results (progress depends on many factors)
- Responsible for individual teaching methods within our quality guidelines
2.3 Our Teachers
Selection Process:
- Multi-round interview process (application review, general interview, mock lesson)
- We may conduct reference checks from previous teaching positions
- All teachers undergo comprehensive background checks
- Teachers working with charter school students complete California DOJ Livescan (where required)
Teacher Status:
- Teachers are independent contractors (not employees)
- Professional music educators who may also teach independently (in-person studios, private online students, etc.)
- Set their own teaching methods within our quality guidelines
- Bound by non-compete agreements and may not solicit Maestro Music students for private lessons outside our platform
- Must adhere to our standards, policies, and code of conduct when teaching Maestro Music students
Selecting Your Teacher:
Option 1: We Match You - Complete our registration form with your needs, preferences, and schedule, and we'll recommend a teacher.
Option 2: You Choose Directly - Browse teacher profiles and book directly with a teacher whose approach resonates with you.
Either way, you're welcome to request a teacher change if the match isn't quite right.
Your Relationship:
- Your contract for lessons is with Maestro Music (we handle all billing and administration)
- All lessons are conducted via Maestro Music's Zoom Business account
- Teachers communicate with Maestro Music leadership regarding student progress and concerns
Communication:
You have flexibility in how you communicate:
Direct Teacher Communication (Most Common):
- Email your teacher directly for scheduling changes, practice questions, lesson concerns, or curriculum questions
- Teachers keep our admin team informed of scheduling changes for billing and coordination
Administrative Support (Always Available):
- Email [email protected] for scheduling assistance, billing questions, teacher change requests, policy questions, or technical support
- Use both channels as needed
What We're Responsible For:
- Vetting and selecting qualified teachers through our interview and assessment process
- Ongoing quality oversight and support
- Ensuring teachers follow our policies when teaching Maestro Music students
- Addressing concerns about teaching quality or conduct
- Coordinating scheduling, makeups, and administrative matters
- Maintaining COPPA-compliant lesson transcription through proper Zoom configuration
What We're Not Responsible For:
- Day-to-day teaching methods and curriculum choices (within our quality guidelines)
- Individual student progress or learning outcomes (depends on practice, aptitude, and many factors)
- Personality fit between students and teachers (though we'll work to find a good match if issues arise)
- Teachers' activities or statements outside of Maestro Music lessons
Teacher Changes:
- May occur due to teacher schedule changes, relocation, mutual agreement that a different teacher fits better, or teacher departure from Maestro Music
- We'll provide advance notice when possible, match you with a similar teacher, and ensure smooth transition

8. Scheduling, Absences, and Makeup Lessons
8.1 Standard Scheduling
After your trial, you'll work directly with your teacher to find times that work. Most teachers prefer consistent weekly slots (same day/time each week), while some can accommodate variable scheduling depending on availability and teaching style. We'll match you with a teacher whose scheduling approach fits your needs when possible.

Every student receives 3 "no-questions-asked" sick days per calendar year:
- Use for any reason, no explanation needed
- Resets January 1st, cannot carry over

- No advance notice required (but appreciated)
To use: Email your teacher or [email protected], mention you're using a sick day, propose 2-3 makeup times.
8.3 Emergency Makeups
One additional emergency makeup per month beyond sick days for unexpected situations (sudden illness, family crisis, urgent conflicts, weather issues, technical emergencies). Email your teacher or [email protected] as soon as possible.
8.4 No-Shows and Last-Minute Cancellations
Please communicate with us even if last-minute. Text or email your teacher, or email [email protected].
We'll work with you to address attendance issues. Repeated no-shows without communication may result in account review or termination. We reserve the right to release the lesson time or terminate the account for severe or repeated violations.
8.5 Extended Absences (3+ Weeks)
With 30 days advance notice: We may prorate tuition and try to hold your time slot (not guaranteed)
Without advance notice: Full tuition typically applies, but we'll still work with you
Common reasons: Vacations, medical situations, temporary schedule conflicts, academic commitments, summer breaks

To change recurring schedule:
- Email your teacher directly to discuss availability
- If they can't accommodate, email [email protected] to discuss switching teachers
- Give as much advance notice as possible (ideally 2+ weeks)

We do not guarantee specific learning results or timelines, uninterrupted or error-free lessons, immediate resolution of technical issues, particular teacher availability indefinitely, preferred lesson times always available, or that students will enjoy lessons or continue practicing.
10.4 Student Progress Disclaimer
Musical progress depends on many factors outside our control: quality and frequency of practice (most important), natural aptitude and prior experience, instrument quality and condition, home practice environment, student motivation and engagement, age and developmental stage, and external stressors.
We provide high-quality instruction and experienced teachers, but cannot guarantee specific outcomes or progress rates.
10.5 Assumption of Risk
You acknowledge and accept risks inherent in online education: technology failures or interruptions, miscommunication in virtual settings, limitations of video-based instruction, potential for misunderstandings without in-person interaction.
10.6 Indemnification
You agree to indemnify and hold harmless Maestro Music, its owners, teachers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: your violation of these Terms, your violation of any law or third-party rights, your use or misuse of services, actions of your student during lessons, disputes with teachers or other families, failure to supervise minor students appropriately, or unauthorized recording or distribution of lesson content.

- Each party pays own legal fees unless arbitrator awards fees to prevailing party

Exception - small claims court: Either party may bring claims in small claims court if claim is within monetary limits and brought in proper jurisdiction (Lane County, Oregon).
14.4 Class Action Waiver
You agree to resolve disputes individually, not as part of a class action.
This means: no class action lawsuits, no joining with other users for collective claims, each dispute handled separately, you may only seek relief on individual basis.
If you don't agree: Notify us in writing within 30 days of accepting these Terms.
If this waiver is unenforceable: The arbitration agreement is void, but rest of these Terms remain in effect.
14.5 Governing Law and Jurisdiction
Governing law: Laws of the State of Oregon, United States, without regard to conflict of law principles.
Jurisdiction: Any legal proceedings (arbitration or small claims) must be conducted in Lane County, Oregon (if in-person) or via video conference.
